Employee or Independent Contractor? |
Determining whether an organization's workers are employees or independent contractors is an important decision that directly affects AP. Making the wrong decision can turn into a reporting nightmare.
Nearly 30 percent of all current IRS audits focus on worker classification. The IRS recently ruled that Federal Express' 15,000 drivers are employees, not contractors, meaning the company may face:
- $319 million in taxes and penalties for a 2002 audit.
- $1 billion in taxes and penalties for the 2004-2006 audit.
- Numerous lawsuits from former FedEx drivers.
To avoid similar situations, organizations should make sure they correctly classify their workers.
